Contracting us to do work
Work will not be scheduled until we receive a signed acceptance of our quotation.
When you accept our quotation for work we may ask for a payment in advance towards equipment, material & other costs and / or staged payments.
Quotations
All quoted figures do not include VAT which must be added at the relevant current rate.
Access and services
You must provide access to site and power & water when work commences this includes a serviceable hosepipe.
Payment for work
Full and final payment is due on the day that work is completed by bank transfer, we do not offer credit terms under any circumstances. We can accept payment in cash, by cheque or by card by arrangement.
An advance payment towards goods and materials ordered may be required and on some projects interim payments may be required.
All materials and equipment remain the property of ROI Group Limited t/a ROI Landscapes until all outstanding amounts have been paid in full.
If you are a business late paying for goods or a service we reserve the right to charge interest at 8% plus the Bank of England base rate and debt recovery costs.
Commencement and delays
You will be given notice of a commencement date in advance.
We endeavor to keep to commencement dates but delays do sometimes occur due to inclement weather, additional work required on projects or other reasons beyond our control.
Pond repairs
Identifying and repairing leaks and damage to ponds and systems may not be straight forward and making a diagnosis and / or repair could involve repeat visits that are chargeable. If repairs can not be made due to the nature of damage found during a diagnosis or once work has commenced to make repairs we will advise of possible remedies and provide a quotation for rectification. If you do not want work to continue you will be charged for work completed including a full day when work ceased.
Advice
There may be a charge for our visit, advice over the telephone, email or in person at our premises is free but a charge will be made if we visit your premises for advice.
Work outside our normal working area
Where we provide our services outside our normal working area a charge may be made for an initial visit & assessment. If subsequently appointed you may be charged for overnight accommodation and food.
Fish and temporary holding facilities
If fish need to be temporarily removed from your pond we will provide temporary on-site facilities for the duration however we do not accept any responsibility for the loss of any fish should this occur.
If these facilities are required before work commences or for a longer period we can hire them out.
You will be charged for loss or damage to our tanks or equipment.
Planning Permission
If planning permission is required it is the customer responsibility to obtain it before work commences.
Guarantees
If equipment is supplied and requires replacement under guarantee, any guarantee ONLY covers the equipment and does not cover the cost of our attendance at your premises, equipment testing, maintenance, de-installation or re-installation of equipment for which a charge will be made. It is your responsibility to return the equipment to our warehouse at your expense for testing and replacement if valid.
Statutory Rights
Your statutory rights are not affected by these terms and conditions.

Conditions of use

Disputes
By using this website, you agree that the laws of the United Kingdom, without regard to principles of conflict laws, will govern these terms and conditions, or any dispute of any sort that might come between The Pond Consultancy and you, or its business partners and associates.
Any dispute related in any way to your use of this website or to products you purchase from us shall be arbitrated by Uniyed Kingdom court and you consent to exclusive jurisdiction and venue of such courts.
Indemnification
You agree to indemnify The Pond Consultancy and its affiliates and hold The Pond Consultancy harmless against legal claims and demands that may arise from your use or misuse of our services. We reserve the right to select our own legal counsel.
Limitation on liability
The Pond Consultancy is not liable for any damages that may occur to you as a result of your misuse of our website. The Pond Consultancy reserves the right to edit, modify, and change this Agreement at any time. We shall let our users know of these changes through electronic mail. This Agreement is an understanding between The Pond Consultancy and the user, and this supersedes and replaces all prior agreements regarding the use of this website.
